General terms and conditions Nail studio Miss Jo Nails

1. General
These conditions apply to every offer, treatment and transaction between the nail studio and a client to which the nail studio has declared these conditions applicable, insofar as the parties have not expressly and in writing deviated from these conditions..

2. Nail salon efforts
The nail studio will carry out the treatments to the best of its knowledge and ability and in accordance with the requirements of good craftsmanship and on the basis of the current state of science. The nail studio will inform the client as much as reasonably possible about the financial consequences of the change or addition to the treatment.

3. appointment
The client must report any impediment to an appointment to the nail studio as soon as possible, but no later than 24 hours prior to the appointment. If the client does not comply with this obligation or does not do so on time, the nail studio may charge the client the full or partial amount for the agreed treatment. If the client arrives at the studio more than 10 minutes later than the agreed time, the nail studio may shorten the time lost on the treatment and still charge the entire agreed amount. After 20 minutes the appointment will be canceled and the client will be charged the full or partial amount for the agreed treatment.

The nail studio must notify the client of any impediment to an appointment as soon as possible, but no later than 24 hours prior to the appointment. Both parties do not have to comply with these obligations if they are hindered by force majeure. Force majeure includes what the law and case law says about this, including strikes in the nail salon.

4. Payment
The nail studio lists all prices of treatments and products visibly in the nail studio. The reported prices include VAT.
The nail studio will clearly state price changes 30 days before the effective date in the studio. Offers in advertisements are valid for the stated period and/or while supplies last. The client must pay for the treatment and any products immediately after the treatment via tikkie (payment request) or exact cash (up to a maximum of €100). Payment in installments is only possible after consultation with the nail studio.
Reservation fees (part of the booking) are non-refundable, but can be rescheduled if an appointment is rescheduled within the specified period.
In the event of a no show, a collection agency will be contacted after 2 reminders. These costs are in addition to the booked treatment costs for the customer.

5. Staff in the studio
The nail studio has the right to have certain work carried out by employees without prior consultation with the customer, if the nail studio considers this desirable for the proper execution of the treatment.
The customer will not allow employees of the nail studio to work for him directly or indirectly until one year after the last treatment in the nail studio, unless written permission has been given by the nail studio.

6. Personal data & privacy
Before the first treatment, the client provides the nail studio with all information that the nail studio indicates is necessary or of which the client should reasonably understand that it is necessary for the careful execution of the treatments. The nail salon records the client's personal data in an automated system and on a customer card. The nail salon handles the client's confidential data in accordance with the guidelines in the Personal Data Protection Act. The nail studio will not sell or rent client data to third parties without prior written permission from the client.

​7. Secrecy
The nail studio is obliged to maintain confidentiality of all confidential information provided by the client during the treatment. Information is considered confidential if this has been communicated by the client or if this arises from the nature of the information. The confidentiality lapses if, on the basis of a legal provision or a court ruling, the nail salon is obliged to provide the confidential information to third parties.

8. Liability
The nail studio is not liable for damage of any nature whatsoever caused by the fact that the nail studio relied on incorrect and/or incomplete information provided by the client about relevant physical conditions, medication use, work or leisure activities. The nail studio is not liable for loss, theft or damage to personal property that the client has brought to the studio.

9. Warranty
The nail studio gives the client a one-week (7-day) guarantee on the treatment and products. This warranty becomes void if:
– The client has had the artificial nails maintained by another nail studio.
– The client has worked with aggressive chemicals without gloves.
– The client has bitten off or deliberately broken off the artificial nails.
– The client has used products other than those recommended by the nail studio for the maintenance of the artificial nails.
– The client has not followed the advice for home care of the artificial nails, as described in the advice brochure.
– The client has not followed the advice to seek medical help within five working days.
– The client has not used the products according to the instructions for use.
- Customized products.
- Otherwise stated.

​10. Damage and theft
The nail studio has the right to demand compensation from the client if the client damages furniture, equipment or products. The nail salon always reports theft to the police. The statutory fine will be included in the compensation.

11. Complaints
If the client has a complaint about the treatment or a product, this must be reported in writing to the owner of the nail studio and the treating stylist as soon as possible, but within five working days after discovery. The nail salon must provide the complainant with an adequate response within five working days. If a complaint is justified, the nail salon will perform the treatment again as agreed, unless this has demonstrably become pointless for the client and the client makes this known in writing. If the nail salon and the complainant cannot reach an agreement, the complainant can submit the dispute to the legislator or mediator.

12. Age
The minimum age that applies in the nail studio for applying artificial nails (gel or acrylic) is 16 years unless other agreements have been made in writing. For other treatments under 16 years of age, please contact the nail studio.

​13. Nail art
If the nail studio shows an example of a nail art design to be applied, this is only an indication. The result on the client's nails does not have to be identical to the example shown. The copyright on applied nail art motifs rests with the nail studio. If the client has the applied nail art photographed for commercial use, permission must be requested in advance from the nail studio. The nail salon may demand a reasonable compensation for this.

14. Decent behavior
The client must behave properly in the studio according to generally accepted standards. If the client continues to exhibit inappropriate behavior after repeated warnings, the nail salon has the right to refuse the client access to the salon, stating reasons.

The entire amount of the booked treatment will be charged.

15. Right
Dutch law applies to every agreement between the nail studio and the client.

In case of interpretation of the content and scope of these general terms and conditions, the Dutch text always prevails.

The most recently filed version or the version that applied at the time the agreement was concluded always applies..
